1. Acceptance of Terms
By using TravelTally90 ("the App"), you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you must not use the App.

2. Use of the App
TravelTally90 is a calculator tool designed to assist users in estimating their Schengen visa-free travel days. The App is for illustration purposes only and should not be relied upon as the sole means of determining visa eligibility or travel permissions.

3. Age Restriction
The App is not intended for use by individuals under the age of 18. By using the App, you confirm that you are over 18 years of age.

4. Disclaimer of Warranties
The App is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. However, this does not affect any warranties which cannot be excluded or limited under applicable law.

5. Limitation of Liability
To the extent permitted by applicable law, the App developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use the App
• Any overstays or errors that result in an overstay as a consequence of following the calculations provided by the App
• Any unauthorized access to or use of our servers and/or any personal information stored therein

Nothing in these terms shall limit or exclude our liability for death or personal injury resulting from our negligence, fraud, or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.

6. User Responsibility
Users are solely responsible for checking their eligibility for visa-free travel within the Schengen zone. The responsibility lies entirely with the user to verify that any calculations made using the App align with the official guidance provided by the European Union. 7. Indemnification
You agree to indemnify, defend, and hold harmless the App developer from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the App, to the extent permitted by applicable law.

8. Data Protection and Privacy
The App does not collect or store any personal user data or trip information on our servers. Trip configurations are encoded into shareable URLs, which do not contain personally identifiable information. 9. Intellectual Property
All content, design, graphics, compilation, magnetic translation, digital conversion, and other matters related to the App are protected under applicable copyrights, trademarks, and other proprietary rights. Copying, redistribution, use, or publication by you of any such parts of the App is strictly prohibited.

11. Updates and Termination

14. Dispute Resolution
If you have any concerns or disputes about the App, please contact us first and we will do our best to resolve the issue informally. If we are unable to resolve the dispute informally, we both agree to resolve the dispute through mediation before resorting to more formal methods of resolution.

15. Severability
If any provision of these Terms is found to be unenforceable or invalid under any applicable law, such unenforceability or invalidity shall not render these Terms unenforceable or invalid as a whole.

16. Entire Agreement
These Terms constitute the entire agreement between you and the App developer regarding your use of the App and supersede any prior agreements.

17. Right to Withdraw
You have the right to withdraw from this agreement within 14 days without giving any reason. To exercise the right of withdrawal, you must inform us of your decision by an unequivocal statement (e.g. a letter sent by post or email). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
